    What is a trademark ?

A trademark is a distinctive sign (name, logo, combination of colours, sound, slogan etc.) which serves to identify the products and/or services of a company.

The conditions when filing a trademark :

    • 1) Its availability: the distinctive sign which characterizes the trademark must not have been filed to designate products and/or services which are identical (and/or similar).

    • 2) Its distinctiveness: the distinctive sign must not be deceptive, descriptive or going against accepted standards of behaviour.

    • 3) The trademark must be filed in the class of products and/or services corresponding to the company’s activity.

    • 4) The trademark must be operated.

    Examples of trademarks :

Sturia for Gironde caviar and food products based upon caviar.

    www.caviar-sturia.com

    Aquinov for IP consultancy services.

    www.aquinov.fr

Vectisol for a molecular complex which, when added to a specific solution, provides an improvement in the preservation of organs for transplant.

    Advice from the Aquinov expert

« Always include the trademark issue in your industrial and economic strategy and ask yourself the right questions :

    - Under what form(s) must I file my trademark (name, logo, both etc.)?

    - How can the risks of confusion with previous trademarks be avoided?

    - For what products and/or services am I going to operate my trademark?

    - Mustn’t I file a three-dimensional trademark ?

    - Must I file in colour?

    - I am using a declension of words: must I file as many trademarks as there are declensions?

Aquinov will help you to answer all these questions and will advise you on how to adapt your choices to your company’s global strategy. »

    Electronics and IT

« Inventions in the Electronics and IT fields are often at the borderline of the patentability defined by the texts and case law.

These conceptual inventions implemented by IT tools such as computers or simple microprocessors, can and must nevertheless be protected since they are inventions in the same sense as those belonging to traditional sectors such as Chemistry or the automobile sector.

To this effect, only a specialist who masters the specificity of patent law in these fields will be able to identify and present the patentable elements of such inventions. »
